Do you intentionally or unknowingly sell an illegal insecticide chalk?
Perhaps the supplier of your illegal insecticide chalk did not share the following with you.

Use of the name “Miraculous Insecticide Chalk” or a close resemblance (i.e. Miraculous Cockroach Killing Chalk) by any other company is ILLEGAL and a contravention of Act 36 of 1947.
ILLEGAL AND UNREGISTERED INSECTICIDE CHALK
· Insecticide Chalk must display a license nr. on the packaging, governed by Act 36 of 1947 and renewable each year. It must display local distributor details, address and contact numbers.
· Packaging must be approved by Registrar: Act 36 of 1947.
· Legally imported insecticides are imported with approval from SARS and customs.
ACTION THAT WILL FOLLOW IF ILLEGAL AND UNREGISTERED INSECTICIDE CHALKS ARE FOUND
· All illegal insecticide chalk will be confiscated.
· Inspectors will insist on details such as origin and importer/distributor details.
· It is standard procedure for inspectors to notify SARS about illegally imported insecticide chalk and the source where it was found. SARS will do their own investigation. SARS will insist on import and customs documentation and proof that import duties were paid.
· Department of Agriculture will submit full details of their investigation to the NPA (National Prosecuting Authority). The NPA will decide which action to take and can include criminal charges against any person selling illegal insecticide chalk. This includes the importer and retailer. The law states that it is your responsibility to ensure that you don’t deal in illegally imported products or chemicals.
· You will face SARS and the NPA. It might lead to a long and very expensive legal battle to clear your name.
Should a child accidentally/on purpose consume some of this illegal chalk, you will be under direct investigation as the supplier to the public. The doctors will not know how to treat the patient as there is no Material Safety Data Sheet, as in the case with our legal product.
